Statement of Limited Liability
Maple Industrial Products Inc. (“Seller”) expressly warrants to all purchasers (“Buyer”) of all new welding and cutting equipment, helmets, and replacement parts (“Goods”) that Goods shall be free from manufacturing defects in materials and workmanship which are discovered within the warranty period, subject to the disclaimers and limitations of this Statement.
This warranty is void if the equipment has been subjected to improper installation and testing, improper care, unauthorized repair and modification, or abnormal operations.
Warranty Period
Condition of Warranty to Obtain Warranty Coverage
Buyer must contact Seller requesting warranty coverage within thirty (30) days from the date the defect is made known to the Buyer at orders@mapindpro.com.
Final determination of warranty on welding and cutting products will be made by Seller. Keep in mind that we will not approve any claim caused by parts that are designed to be susceptible to wear and tear, including but not limited to:
- Consumable components, such as contact tips, cutting nozzles, contractors, relays, or parts that fail due to normal wear.
- Equipment that has been modified by any party other than MapleWeld, or equipment that has been improperly installed, improperly operated or misused based upon industry standards, or equipment which has not had reasonable and necessary maintenance, or equipment which has been used for operation outside of the specifications for the equipment.
- Defects caused by accident, unauthorized repair, or improper testing.
Warranty Repair
If Seller confirms the existence of a defect covered by this warranty, the defect will be corrected by repair or replacement at Seller’s option, either at Seller’s warehouse or a service facility authorized by Seller.
In lieu of repair or replacement, if Seller elects, Seller may, upon return of such Goods and making a determination of nonconformity or defect, keep the Goods and refund the purchase price based on depreciation. Only at Seller’s request, the Buyer must return any Goods claimed defective under the warranty.
Freight Cost
Buyer is responsible for shipment to and from the Seller’s warehouse, or a service facility authorized by Seller.
Limitation and Disclaimer
Goods are intended for commercial and industrial users who are trained and experienced in the use and maintenance of welding equipment. Buyer’s remedies shall be limited exclusively to those provided in this Statement. There are no express warranties other than those contained herein. Seller does not warrant any portion of the Goods not manufactured by Seller or its associates (whether or not specified by Buyer), but Seller shall assign to Buyer upon request all assignable warranties on products of Seller’s suppliers related to such Goods. Seller does not warrant that it or the Goods are in compliance with any entity, organization, or industry standards, guidelines, or procedures unless specifically contained in a writing signed by Seller.
SELLER WILL NOT ACCEPT RESPONSIBILITY OR LIABILITY FOR REPAIRS MADE OTHER THAN BY SELLER OR A SERVICE FACILITY AUTHORIZED BY SELLER. SELLER’S LIABILITY UNDER THIS WARRANTY SHALL NOT EXCEED THE COST OF CORRECTING THE DEFECT OF THE SELLER PRODUCT. SELLER WILL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES (SUCH AS LOSS OF BUSINESS, ETC.) CAUSED BY THE DEFECT OR THE TIME INVOLVED TO CORRECT THE DEFECT. THIS WRITTEN WARRANTY IS THE ONLY EXPRESS WARRANTY PROVIDED BY SELLER WITH RESPECT TO ITS PRODUCTS. WARRANTIES IMPLIED BY LAW, SUCH AS THE WARRANTY OF MERCHANTABILITY, ARE LIMITED TO THE DURATION OF THIS LIMITED WARRANTY FOR THE EQUIPMENT INVOLVED.
